1. Acceptance and Changes
   • We, at Talia Zoref Art maintain this website (or any other domain name used in order to operate the Talia Zoref Art website) (the “Website”) as a service to you and others from the internet community (“you”, or the “Users”, or the “Buyers” or the “Purchasers”). Access to and use of information presented on this Website is subject to the following terms and conditions ("Terms") which may be revised at any time by Talia Zoref Art, as well as to the Privacy Policy located on the Website at  https://shop.taliazoref.com/pages/privacy-policy (the “Privacy Policy”) and is being incorporated hereto by reference.

• This Website is a shop providing products and/or services for sale to a wide variety of audiences. By using and accessing this Website, you agree to be bound by these Terms of use including any amendments to the content of this website including changes to and/or deletions of products and/or content on the website that may be made by Talia Zoref Art from time to time at its sole discretion. Talia Zoref Art encourages the users of this Website to periodically review these Terms for any changes or amendments.

• From time to time and at our sole discretion, we may amend, change or replace these Terms. All such modifications to the Terms shall become effective upon the posting of the revised Terms or by receipt of notification of a change to the Terms. If you do not agree to the new or different Terms, you should not use or access the Website.           

2. Content and Ownership
   • Ownership. All rights, including any and all copyrightable materials or any other content thereof which is or may be subject to any intellectual property rights under any applicable law, including without limitations any artwork, graphics, images, literary work, audio, music, video and other media, designs, animations, interfaces, products, interactive features and objects, advertising and acquisition tools and methods, logos, domains, service marks, trade names and other proprietary identifiers, whether or not registered and/or capable of being registered, and any derivations thereof, are exclusively owned by and/or licensed to us (“Proprietary Content”). Please note that in the event that the Proprietary Content is licensed to us, then such content might be subject to additional restrictions by its owners.
   • All featured artwork, images and designs on this website created by Talia Zoref Art are the sole property of Talia Zoref Art. All the images on this site may not be used, published and/or distributed without express formal written consent from Talia Zoref. Any duplication and/or use of images and/or designs from this website may be subject to legal action.
   • You are hereby prohibited from removing or deleting any and all copyright notices, restrictions and signs indicating proprietary rights of Talia Zoref Art, including copyright mark [©] or trademark [™], and you represent and warrant that you will comply with all applicable laws in this respect.
   • No Other Rights. It is hereby clarified that these Terms do not grant any right or interest in or to our intellectual property (or any part thereof), including without limitations, any of our Proprietary Content. For the avoidance of doubt, nothing in these Terms constitutes an assignment or waiver of any of our property rights under any law.
     
     
3. Terms of Sale
   • These Terms of Sale apply to all offers made by Talia Zoref Art including all purchases and confirmed orders placed by you; and all agreements concluded between us in relation to the products offered on this website.
   • Due to the nature of the products, all sales are final.
   • An order submitted by you will not be deemed to be accepted by Talia Zoref Art unless and until you, the buyer receive an order confirmation form from Talia Zoref Art.
     
     
   • REFUNDS AND CANCELLATION
     • We do our utmost to ensure that you will be happy with your Art. If you are not satisfied with your order, please email us at contact@taliazoref.com.
     • All sales are final unless the order has arrived damaged from the delivery process. Talia Zoref Art does everything possible to ensure that the product will be delivered in the most professional manner to prevent any damage from occurring while in transit.
     • You are responsible for inspecting the order upon arrival and informing Talia Zoref Art within 48 hours with any concerns. In the event that there is a problem, please send Talia Zoref Art a message including photo evidence of the damage to the package and/or the contents so that we may act accordingly.
     • Return of damaged goods is within 14 (fourteen) days of receipt of the product with written notice to Talia Zoref Art.
     • Item(s) to be returned must be in original unused condition; all tags, cards, boxes and/or packaging must be included with your return.
     • Return shipment of the item must be conducted within 5-7 (five to seven) business days following your written notification of return.
     • Return shipments conducted after 30 (thirty) days of receipt will not be accepted.
     • Note that shipping and handling charges are non-refundable. In the event of the arrival of damaged or defective goods during delivery, please be in touch with Talia Zoref Art concerning the cost and payment of the return shipping. If you are entitled to a refund for the item, your refund will be credited back to your original method of payment within 10-15 business days of receipt of the damaged and/or defective goods. If you would prefer to receive a replacement item, please let us know with your written notification. If the replacement item is no longer available, we will be in contact with you. If we are unable to contact you, we will cancel the order and conduct the refund.
       
       
   • PRICES
     • Prices may change from time to time, but such changes will not affect orders, which have already confirmed at the time of the change.
     • Prices do not include VAT and/or any local sales taxes.
     • As the buyer, you are liable for covering all local VAT, customs fees, import duties and sales tax in order to release your order upon arrival.
     • In the event that you may refuse to pay the duties required to release your order and if the delivery is returned to Talia Zoref Art, there will be no refund issued on the returned item. Talia Zoref Art will also have the right to charge you for any additional shipping and handling fees incurred due to return of the goods in such a situation.
       
       
   • PAYMENT
     • Your payment is securely processed by Paypal.
       
       
   • SHIPPING AND DELIVERY
     • We take the utmost care to ensure that your shipment is packed well and will arrive safely in a timely manner. Sometimes however, packages may get held up in customs or may possibly incur extra fees. Such circumstances are beyond the control of Talia Zoref Art.
     • Due to the nature of our products, orders may take up to 5-7 business days to ship.
     • Customized orders will be shipped according to timelines agreed upon between the parties.
     • Talia Zoref Art does not cover any customs or extra fees associated with shipment deliveries.
     • Note that due to the current situation with COVID-19, delivery times might be longer than usual for shipments depending on the location. Please also make sure not to use delivery addresses such as a buildings or offices that might be closed because of the situation.
     • Sometimes shipment deliveries may be delayed due to circumstances that are beyond the control of Talia Zoref Art. Talia Zoref Art cannot be held responsible for such delays including, but not limited to the following circumstances:
       Strikes, natural disasters, fire, epidemics, terrorist activities, civil unrest and war.
     • Note that estimated delivery times are just approximate expected delivery times. They are not guaranteed delivery times and they should not be understood as such.
     • Domestic shipping is free.
     • International shipping is free for purchases of above US$ 275.
       
       
   • ORDER AND DELIVERY DETAILS
     • You confirm that all the order details entered in the purchase order for Talia Zoref Art including, but not limited to purchaser name, recipient name if different from purchaser name and delivery address details are correct and accurate to ensure that the order is conducted and delivered successfully to the recipient of the Talia Zoref Art.

4. Privacy and Data Protection
   As mentioned, in addition to these Terms, your use of the Website is also subject to our Privacy Policy, which informs you of our policies regarding the use of the Website.

5. Limited Warranties
   We make no warranty that the Website or the content will meet your requirements, or will be uninterrupted, continuous, timely, secure, accurate, correct, complete or available; including without limitations, in connection with any errors, bugs, viruses, Trojan horses and/or any other form of malware, server runtime and/or downtime (including any interruption or cessation of any data received and/or otherwise transmitted within the scope of the use of the mobile application), server security measures, content uploaded by other users and/or yourself (including any personal, financial and/or any other information) or for any loss or damage of any kind incurred as a result of the use of any content posted and/or transmitted. However, we will do our best in order to create a great and safe user experience as well as do our utmost to make sure that your order is processed smoothly.

We do not endorse or approve any content provided by any party other than us and disclaim all liability whatsoever thereto. Nothing herein shall derogate from any other limitation of liability prescribed under these Terms.

6. Errors, Inaccuracies and Omissions
   • Very rarely on the odd occasion, you may find that the product may not exactly match what you see online. If such an occasion occurs and you believe that the order contains a mistake, please let us know as soon as possible so that we may correct errors as soon as possible since we do our best to depict and describe our artwork accurately on the website.
   • Framed product images are used are for illustrative purposes only. The dimensions given for artworks are illustrative of the size of the painting and/or print without the frame. 
   • If you receive a product that is not as described on our website, we would be pleased to remedy the situation, therefore please kindly notify us in writing immediately without any delay and include a photo of the product with the notification.
   • In the event of return of an item, you must return the product in original unused condition with all tags, cards, boxes and/or packaging included with your return.
   • Return shipment of the item must be conducted within 5-7 (five to seven) business days following written notification of return.

7. Links to Third Parties’ Websites
   The Website may provide links to other websites or resources via Hyper-Links. Since Talia Zoref Art has no control over such sites and resources, you acknowledge and agree that Talia Zoref Art is not responsible for the availability of such external sites or resources, does not endorse and is not responsible or liable for any information, advertising, products, or other materials on or available from such resources. You further acknowledge and agree that Talia Zoref Art shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such information, goods or services available on or through any such resource.

 

8. Limitation of Liability
   You expressly understand and agree that Talia Zoref Art including its employees, sub-contractors and agents shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages including but not limited to damages for loss of profits, goodwill, use, data or other losses (even if Talia Zoref Art has been advised of the possibility of such damages), resulting from the use or the inability to use this website and/or information provided therein..

9. Indemnification
   You agree to indemnify, defend and hold harmless Talia Zoref Art, its employees, sub-contractors, affiliates, agents and anyone acting on their behalf, at your own expense and immediately after receiving a written notice from Talia Zoref Art, from and against any damages, loss, costs, expenses and payments, including reasonable attorney’s fees and legal expenses, resulting from any complaint, claim, or demand, arising from or related to your breach of these Terms, or any other terms, rules or regulations applicable to this Website.

10. Miscellaneous
    • Governing Law. These Terms of use shall be governed in accordance with the laws of the State of Israel without giving effect to any conflicts of law principles. Any dispute in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts situated in Tel Aviv, Israel.
    • Severability. If any provision of these Terms shall be deemed to be invalid, void, illegal or for any reason unenforceable, that term or condition shall be deemed severable and shall not affect the validity and enforceability of the remaining terms set forth herein.
    • Any content displayed in the Website is provided for the purpose of selling products to the Users of this Website and provide them with certain information which Talia Zoref makes available through the Website.
    • Contact Us. If you have cause to believe any content found in the Website to be in violation of these Terms and/or infringe any 3^rd party proprietary rights and/or applicable law, kindly notify us of such content via email to contact@taliazoref.com, stating the violating content and the nature of violation.
